•Rental Policies Agreement - 1904 Preston Hill Road Hamilton, NY - "Preston Hill Modern"

 

•CHECK-IN:
3:00 PM Eastern Standard Time (EST) or later. Occasionally the housekeeper may need additional time in order to ready the home for your stay. We ask for your patience in the event additional time is needed. Please do not interrupt or delay the housekeepers if they are at the house. Let us know immediately if the house has not been properly cleaned.

 

•CHECK OUT:
•By 11:30 AM EST. A $50 per hour fine will be assessed for guests remaining after 11:45 am EST on the day of check-out unless late check-out has been approved in writing in advance.

 

•This lease is between the Lessee or guest and S.A. Holmes or Lessor.

 

•All of our reservations are made online so that you can agree to the rental terms, and have a secure payment interface for your payment.

 

•You will receive a reservation confirmation email. Carefully CHECK your confirmation for accuracy and email holmessa2008@gmail.com immediately if any corrections are necessary; otherwise, it will be assumed correct. Lessor reserves the right to correct any monetary calculation errors. In the unlikely event this occurs, the guest will be promptly notified and sent a correct reservation email.

 

•PAYMENT TERMS:
• 70% Payment is due at the time of reservation booking. Except for graduation stays- see below.
• 100% Payment is due at the time of reservation for Colgate graduations.
• The remaining balance is due 60 days prior to arrival.
• Reservations made for Colgate graduations are NON-REFUNDABLE. PLEASE BE SURE OF YOUR STAY BEFORE YOU BOOK.

• Payments can be made through Paypal using American Express, Visa, MasterCard or Discover.

 

•FEES:
•There is a 3% credit card processing fee on all reservations.
•A cleaning fee of $135.00 will be billed on every reservation.
•In lieu of a security deposit a small fee for accidental damage insurance is billed on every reservation. See details below under "Damage Waiver."

 

•CANCELLATIONS:
•All cancellations must be made 60 days prior to arrival.
•Reservations made for Colgate graduations are NON-REFUNDABLE.
•All other cancellations must be submitted in WRITING to holmessa2008@gmail.com . Lesser will confirm by email.
•For cancellations between 60 and 180 days or more before arrival, a 30% cancellation fee will be charged and the remaining amount paid will be refunded.
•Cancellations or date changes occurring less than the stated 60 days prior required notice will result in forfeiture of initial reservation payment, rent, taxes and fees.

 

•DAMAGE WAIVER:

•In lieu of a standard security deposit, guest agrees to pay a non-refundable accidental damage waiver of $39.00 or $69.00 (fee depends on length of stay). 2 nights or less the fee is $39.00 ($1,500.00 max coverage), 3 nights or more the fee is $69.00 ($3,000.00 max coverage). These fees cover from $1,500.00 up to $3000.00 of accidental or unintentional physical damage caused by guest. In the event damage to the unit exceeds the maximum coverage amount, guest agrees to compensate for this damage. The Damage Waiver is intended to cover damage, not additional cleaning beyond normal amounts. Extra cleaning is billable to guest. Missing items are not covered by the damage waiver and will be billed to the guest.

 

•MAINTENANCE ISSUES AND DAMAGES:
•Report all maintenance issues promptly by calling Lessor at 212-920-4219. Every effort will be made to correct the situation; however, no refunds or rates adjustments will be made for mechanical or maintenance issues and/or failures.

 

•NO GUARANTEES:
Working condition of radiant heat flooring, internet service, TVs, appliances, etc. are NOT guaranteed. NO REFUNDS or rate adjustments will be made for mechanical failures and malfunctioning equipment. Although we will do everything within our power to correct the situation promptly, some breakdowns cannot be prevented or repaired during your occupancy.

 

•DAMAGE:
Report any damage or breakage upon occurrence by calling 212-920-4219 so the matter can be settled before departure.

 

•NO SMOKING:
Guest acknowledges that smoking is prohibited inside the house and on the grounds. Cleansing the unit of a smoke smell is costly as it may require cleaning of blinds/ curtains, furniture, carpets, etc. Smoke smell is very obvious in the house. If it is detected following a guest’s stay, a damage claim will be filed, and the guest will no longer be able to rent the property in the future.

 

•MINIMUM RENTAL AGE:
•Only responsible adults ages 25 or older may contract to rent the property from Lessor. Legal renter named on the rental agreement must occupy property during dates listed on rental agreement.

 

•OCCUPANCY:

•Maximum occupancy of 6 includes adults and children above the age of 7. Violation of maximum occupancy is grounds for immediate eviction and forfeiture of rent.

 

•EVENTS: Contact Lessor to discuss.


• NO HOUSE PARTIES ARE ALLOWED, however small Graduation Parties/Group Events/Weddings are allowed if pre-approved in writing by Lessor. Additional fees and rates apply. Unapproved events are cause for eviction without refund of rent or fees.

 

•PARKING:
•There is ample parking in front of the house in the driveway. DO NOT PARK ON THE STREET OR BLOCK THE NEIGHBORS’ DRIVEWAY.

 

•PETS:
•No pets are permitted.
Although we love animals, we don’t permit yours in our home. If the presence of a pet is determined while renting the house the guests will be evicted immediately and remaining rent and fees will be forfeited. If evidence of a pet is discovered after check out, then damage fees will be billed. The guest will no longer be able to rent the property in the future.

 

•PRIVACY & SECURITY :
•Our property is located in a very safe community. However, we strongly advise our guests to lock all doors and windows upon retiring, and when absent from the property. Guests will be held responsible for the loss of furnishings, appliances, and other items from the property during their stay.

 

•MANAGEMENT:
•WE RESERVE THE RIGHT to refund reservation payments, refuse rental, or to discontinue occupancy if, in our judgment, your occupancy is detrimental to the property. If evicted, all rent and fees are forfeited.
•An atmosphere conducive to quiet enjoyment of those in surrounding properties must be maintained at all times.
•Property may not be used for any unlawful purpose.
•We reserve the right to enter the premises at any time for the purpose of inspection, repair, or management.
•Rates, descriptions, furnishings, amenities and availability are subject to change WITHOUT NOTICE. We make every possible effort to keep information accurate but changes do occur.

 

•By renting this property, you are assuming all risks and liabilities for any damage done to person or property, agents, employees or visitors occasioned by the present or future condition of the premises, both latent and manifest. The Lessor will not be responsible for accidents or injury to guests or loss of money or valuables of any kind.

 

•DEPARTURE RESPONSIBILITIES :
•We know you are on vacation and appreciate you choosing to stay with us! Please leave the home neat and orderly to avoid additional charges. If the housekeeper finds that the home has been left excessively dirty you will be billed for the additional cleaning time at a rate of $100 per hour. We hope you will leave it as you would want your home left. We appreciate your cooperation. Check-out time is 11:30 AM EST.
•Clean and put away all kitchen items.
•Place all trash (including bedroom and bathroom) in outside trash containers.
•Leave beds that have been used unmade.
•Wash soiled towels & leave them folded —fine if last loads are still washing & drying at departure.
•Completely empty the refrigerator.
•Return indoor and outdoor furniture to original position. Close and lock all windows and doors.
•Check the house thoroughly for any personal belongings.
